APD Admits It Is Legal to Buy and Sell Firearms in Texas

The Ellis County Observer has posted a response to an Infowars story, Gun Show Press Release from Austin PD. Helena Wright of the Austin Police Department responded to a Public Information Request by stating the following:

There have been no directives, rulings or regulations on gun shows or private gun sales that have come from APD or BATFE. There also have been no documents discussing directives, rulings or regulations.

APD’s Nuisance Abatement Unit and Firearms Review Unit only made recommendations to a property owner, please see the attached press release. Although we made these recommendations, they were not required by APD or BATFE.

In other words, the APD at the behest of the federal government leaned on a property owner and convinced him to close down the gun show. Helena Wright admits there are “no directives, rulings or regulations on gun shows or private gun sales” in Texas.

The APD and local Austin media are now attempting to convince people it is illegal for private citizens to sell firearms without “proper paperwork.” This is a color of law trick designed to prevent entirely legal gun sales.

In the aftermath of the Massachusetts Senate vote last Tuesday, we now have a concrete fighting chance to block the reappointment of Wall Street puppet Ben Bernanke as the chairman of the Federal Reserve Board of Governors by preventing his Senate confirmation next week. This afternoon, Bernanke’s support was eroding hour by hour. The defections from the Bernanke camp feature Democratic senators who are up for reelection this coming November. They have read the tea leaves from Massachusetts, and they know the pitchforks are out, so their response is a mad rush to acquire economic populist and anti-Wall Street cover. The obvious way to do this is to turn against Bernanke and defeat him in the upcoming confirmation vote. Leading the charge late today were Senator Barbara Boxer of California and Russ Feingold of Wisconsin, both endangered Democrats. GOP Senator Corker of Tennessee is now waffling about whether or not he will support Bernanke. The pressure is building on self-styled Democratic economic populists like Sherrod Brown of Ohio to prove that they are worth something. What will Senator-elect Scott Brown do? If he votes for Bernanke, he will have betrayed his voters in less than a week, and will not survive his own re-election campaign in 3 years. Democratic majority leader Harry Reid, succumbing to overwhelming pressure from the Obama White House, announced late this afternoon that he will fall on his sword for Helicopter Ben, but this self-destructive pledge may not survive a weekend in Nevada, where the economic populist pitchforks are as finely honed as anywhere. It is therefore time for all responsible citizens and all persons of good will to mobilize in the days ahead to secure the defeat of Bernanke. Such an event would symbolize the turn of the tide against Wall Street in the struggle to decide who will pay for the current depression — the people or the bankers and hedge fund hyenas.

We stress that this is a battle which can be won. Two senators, Bunning of Kentucky and Bernie Sanders of Vermont, have placed holds on the Bernanke nomination. This means that a supermajority of 60 votes will be required to bring Helicopter Ben’s nomination to the Senate floor. As of now, no one can know whether these votes will be forthcoming. Republicans have little reason to favor Bernanke over their own careers. The Obama White House, despite its most recent efforts to re-create a populist persona for the chief executive, is foolishly supporting Bernanke — a move which undermines all other economic populist posturing Obama might engage in. Individual Democrats, especially those facing the hour of truth in November, know very well how much Bernanke and his Federal Reserve elitists are hated by Americans. For the moment, this game is therefore out of control and highly vulnerable to the application of mass-based political pressure. If Bernanke can be defeated, the Wall Street-Federal Reserve lockstep will be momentarily broken, and the path to auditing the Fed and, more importantly, nationalizing it as a bureau of the Treasury will be wide open.

Late this afternoon, pro-financier spokesmen on Bloomberg and CNBC were talking about a scenario in which Bernanke would remain no matter what as chairman of the Federal Open Market Committee, the unconstitutional body which sets interest rates in accordance with the wishes of the privately owned Federal Reserve districts, above all the New York one. In this scenario, Donald Kohn, the current Fed Vice Chairman, would take Bernanke’s place as the Chairman of the Board of Governors. Kohn, it will be remembered, is just as odious as Bernanke. About a year ago, Kohn’s impudence, arrogance and elitism were highlighted during a Senate hearing when he indignantly refused to reveal the names of the AIG derivatives counterparties who were receiving some $70 billion of US taxpayer money in return for their worthless and toxic financial derivatives. If Bernanke and Kohn should attempts to maintain their power over the Federal Reserve, meaning in practice short-term interest rates in this country, they will create laboratory conditions for a massive economic populist revolt which could well lead to the seizure and nationalization of the Federal Reserve as a bureau of the US Treasury and a public utility to provide 0% credit for production in the interests of the American people. That would put an end to almost a century of financial insurrection by the Wall Street financiers and their puppets against the Constitution — a blatant illegality which goes back to the days of Woodrow Wilson.

All opponents of the illegal, unconstitutional, and failed Federal Reserve system must now realize that this is the hour of action. It is time for every serious intelligent person to send two e-mails and place two phone calls to the Washington and local offices of their senators demanding that they stop Bernanke. Obama should also be warned that Bernanke is an insult to the American people. Those who have been complaining about the Fed for decades now have a real chance to do something about it. These chances are very rare, but this is the best one in many, many decades. Even Paul Adolph Volcker, who had been responsible for an obscene 22% prime rate three decades ago, had an easier time getting reconfirmed than Bernanke. Once Bernanke has been defeated, it will be time to secure the ouster of Treasury Secretary Geithner, the former head of the New York Fed and currently the most visible member of the entire Obama cabinet. The basic outlines of a criminal indictment for Geithner on tax fraud and securities fraud can be culled from virtually any daily newspaper. Geithner ought to be accompanied on his trip home by White House economic czar Larry Summers, the woman-hating former president of Harvard who managed to destroy about a third of the Harvard endowment as a result of his fanatical devotion to the riskiest of financial derivatives. This and more will be within our reach if Bernanke can be checkmated over the next week or two.

Five members of the Supreme Court declared that a “corporation” is a person, not a “regular person” but one above all natural laws, subject to no God, no moral code but one with unlimited power over our lives, a power awarded by judges who seem themselves as grand inquisitors in an  meant to hunt down all hertics who fail to serve their god, the god of money.

There is nothing in the Constitution that makes this “gang of five” bribe sucking clowns above the law.

Their ruling has made it legal for foreign controlled corporations to flush unlimited money into our bloated political system to further corrupt something none of us trust and most of us fear.  The “corporation/person” that the 5 judges, the “neocon” purists, have turned the United States over to isn’t even American.  Our corporations, especially since our economic meltdown are owned by China, Russia and the oil sheiks along with a few foreign banks.  They don’t vote, pay taxes, fight in wars, need dental care, breathe air, drive cars or send children to school.  Anyone who thinks these things are people is insane.  Anyone who would sell our government to them is a criminal and belongs in prison.  There is nothing in the Constitution that makes this “gang of five” bribe sucking clowns above the law.  There is nothing in the Constitution that even mentions corporations much less gives them status equal to or greater than the Executive, Legislative and Judicial branches of government.

The Supreme Court of the United States has no right to breathe human life into investment groups owned by terrorist sympathizers, foreign arms dealers or groups working for the downfall of the United States and everything we believe in, but 5 “justices” have done just that.  We now have a new government above our government, above our people, one above any law.   Five judges have created institutionalized gangsterism as the new form of government for the United States.

No American soldier can ever go to war fighting for a Chinese hedge fund, a German bank or a Saudi Arabian fertilizer company.  Will our new debates in Congress be between members representing the opium warlords against the Columbian cartels?  Their cash, which long ago has infiltrated one major corporation or bank after another is now heading for your local representative.   How important do you think secure borders for America are for these new policial “influencers?”

For years we complained about AIPAC, the Sierra Club, the NRA, trial lawyers, trade unions, NAM (National Association of Manufacturers) and the churches that got involved in politics.  Behind all of these were people, American citizens, and, on some occasions, Americans who fought for their country, raised kids here and were invested in the survival of America although they didn’t always act that way.  This was an American problem.  Now we aren’t even sure we have an America anymore.

Anyone who believes that a massive flood of corporate money into politics won’t throw control of both houses of Congress into the hands of the wealthy nations that are also our primary strategic enemies, you know the ones, the ones loaded with oil cash, the ones with 10 cent an hour labor and legal systems that  shoot first and ask questions later.  They just were told they can buy the United States, not just our government, but our military, and the lives of our soldiers.  They can now make our laws, raise our taxes, decide on our civil rights, where we can live, if we can own guns, how late we stay up, where and what we drive and, eventually, how we think.  The Supreme Court has given foreign owned corporations the eventual power to silence us all.

When a corporation commits a crime, nobody goes to jail.  When wars come, they don’t fight, they simply rake in cash.  When children are poisoned or workers are killed, they seldom even pay a fine.  However, when they want something, billions in tax money for “bail outs” or fat contracts or special laws, they have always gotten it.  It  has been a battle to control corporations for 140 years.  Sometimes the American people have lost, sometimes they have won.  Our greatest presidents are the ones who reined in corporate power and kept the influence of money over humanity in check.  Think of Theordore Roosevelt, Woodrow Wilson, Franklin Roosevelt, Harry Truman, Dwight Eisenhower and John Kennedy.

Without them we would be living in work camps, stuck at machines all day, our children at our sides.  We would be paid in beans and salt pork, dying at 40 in filth like people around the world who live in countries controlled by corporations.

Based on the justices that we want prosecuted being Reagan/Bush “conservatives” you would think this is a liberal/conservative issue.  Nothing could be further from the truth.  Nothing less “conservative” has ever been done by a branch of our government.  There is nothing “conservative” about our Supreme Court going insane and abandoning our Constitution and making medical decisions, not to give life to a fetus, but to a bank account.

This is nothing but an extremely unAmerican and unpatriotic group of thieves believing that Americans had given up so many of their civil liberties in silence during the Global War on Terror scam that opening the “Pandora’s Box” of class conflict could now be done with nobody saying a word.  Their “corporate person” is now a Baron or Duke, the great landlords of the medieval period.  Americans are now destined for serfdom.  Their political and economic theories, what are they?  Is it conservatism or feudalism?

We are already burdened with a representative government that has tied itself to the money spigot because of the incredible cost of media exposure in campaigns.  People running for office in ancient Rome would purchase thousands of animals for slaughter in the arena.  Mass executions were staged as media events for political campaigns.  In fact, the arenas in every Roman city were built for that purpose, today replaced by television and the internet.  We thought we had changed since that time.  We were wrong.

The framers of the Constitution created the Supreme Court, the Electoral College and originally had Senators appointed, not elected, to protect the wealthy from having their money and land seized by the masses who would otherwise have controlled the government.  This was the 1780s.  The only “democracy” we knew about was ancient Athens, where the majority of the people living there were slaves.    27 Amendments later, including the Bill of Rights, we have worked to define justice and decency.  Generations have fought and died to keep life in our imperfect system from 1780.  Who would have thought that 5 people could destroy it all?

Political debate in America is sometimes extreme, often bordering on violence.  Feelings are high.  How many times have you heard people threaten to leave the country because “their America” no longer exists.  We know that few really mean it.  When faced with a real threat, no people on earth are to be feared like Americans.  When help is needed, no people on earth are to be trusted and relied on like Americans.  This is the pride we have in our country and ourselves.  We never agree on anything.  We aren’t supposed to, we are Americans.

Everything we built has been based on a balance, race, religion, ethnicity, social standing, political beliefs, regional interests, all striving and compromising to build something we are all secretly very proud of, something all of us are willing to fight for and many are.  Americans all agree on one thing, that our government in Washington is out of control and has been for some time.  We all have different ideas on this but agree on the fact itself.  We wonder where the politicians come from, men too often “less great” than those of the past, in fact, less great than average.  Decisions are continually made that most find puzzling and, in fact, are driven by a rotten underbelly of corruption and self interest.

Now, 5 members of the Supreme Court, people none of us voted for, a group that is answerable to no authority and, seemingly, no law or moral code, a group famous for immoderation, poor judgement and low personal integrity has, either through blindness, avarice or insanity clearly done something so malicious, so unjust and so utterly inconsistent with our Constitution that they, themselves, have become an “enemy of the people.”

What is their power?  What they have done is not within the scope of the authority given through the Constitution.  Their acts are outside the law, their acts are those of a conspiracy, their acts are meant to diminish our freedoms, our sacred institutions and even endanger our lives.  Typically, such acts are called crimes and those who commit them are criminals.

What could drive judges, albeit judges appointed with little thought as part of a cheap political ploy, to abandon any American consitutency?  Corporations have no religion.  They care nothing for the unborn.  They have no allegiance to a flag, a family or any moral ethic.  They serve no person, owe no loyalty other that to stockholders, shadowy groups of Russian oligarchs, Chinese banks, corrupt dictators grown fat on the spoils of their people or the international consortiums of bond and currency speculators who have, for decades, abandoned any economic law to build the etherial “house of cards” we call the “world economy.”

The control of the American electoral process has been given to them.  No serving politican can survive now standing against them.  Years ago “they” bought our newspapers and our television networks.  Fact and truth became whatever they wanted us to believe.  “They” gained control of what many thought and what almost all of us see and hear.  That wasn’t enough.  They wanted it all.  As their control has grown, so has terrorism, continual war, economic poverty for millions Americans and insensitivity to justice and humanity.  Who would expect anything else from a corporation with no blood, no heart and no face?

The Founding Fathers led America on the path to freedom and eventual democracy.  The Federalists limited the ability of an impetuous electorate to seize power and “reform” America into chaos and anarchy.  This system of government was predicated on the belief that love of country would always burn brightly in America and with progress, freedom and bounty was the ineviable reward of our industry.  It is only now too obvious that so much has happened that was unforseen.  It is not a denial of our traditions to correct wrongs when we find them.  This was how America was created.  We are drowning in wrongs, we all finally agree on this.

The time is now.  Party politics have failed.  Political theories are little more than empty rhetoric meant to mislead and misinform.  State has become church and church has become state.  State is less just and church less godly.  All we have left is “we, the People.”  This is how we began and it is now all we have to move forward.  It is time for the states to call for a Constitutional Convention to establish, not just a Republic, but a Democracy, by and for the people, the American people, rich and poor, a nation loyal to itself, not tied to corporations, a vast military industrial complex or endless foreign alliances.

If it is to be a genuinely conservative nation, one with individual freedoms, a small government, fewer taxes and more opportunity, a nation as intended, then we will all have to live with it.  The bloated corpse we are creating in Washington is emitting a stench we can no longer abide.  We will be saying goodbye to our Supreme Court, our seniority system in Congress and our political machines pretending to be “parties”  and hello to paper ballots, a free press, term limits and the ability to yank a scoundrel out of office when we catch one.

Wow! UK parliamentary investigation into Climategate may not be a whitewash

The Commons Science and Technology Committee has launched an inquiry into “the unauthorised publication of data, emails and documents relating to the work of the Climatic Research Unit (CRU) at the University of East Anglia (UEA)” – ie Climategate. (hat tip R. Campbell; Platosays).

On 1 December 2009 Phil Willis, Chairman of the Science and Technology Committee, wrote to Professor Edward Acton, Vice-Chancellor of UEA following the considerable press coverage of the data, emails and documents relating to the work of the Climatic Research Unit (CRU). The coverage alleged that data may have been manipulated or deleted in order to produce evidence on global warming. On 3 December the UEA announced an Independent Review into the allegations to be headed by Sir Muir Russell.

The Independent Review will:

1. Examine the hacked e-mail exchanges, other relevant e-mail exchanges and any other information held at CRU to determine whether there is any evidence of the manipulation or suppression of data which is at odds with acceptable scientific practice and may therefore call into question any of the research outcomes.

2. Review CRU’s policies and practices for acquiring, assembling, subjecting to peer review and disseminating data and research findings, and their compliance or otherwise with best scientific practice.

3. Review CRU’s compliance or otherwise with the University’s policies and practices regarding requests under the Freedom of Information Act (’the FOIA’) and the Environmental Information Regulations (’the EIR’) for the release of data.

4. Review and make recommendations as to the appropriate management, governance and security structures for CRU and the security, integrity and release of the data it holds .

But here’s the really surprising part: it’s planning to ask the right questions.

— What are the implications of the disclosures for the integrity of scientific research?
— Are the terms of reference and scope of the Independent Review announced on 3 December 2009 by UEA adequate (see below)?
— How independent are the other two international data sets?

Wal-Mart cuts 11,200 jobs at Sam’s Club

SAN FRANCISCO (Reuters) – Sam’s Club, the warehouse club division of Wal-Mart Stores Inc is cutting roughly 11,200 jobs, or about 10 percent of its workforce, as it outsources in-store product demonstrations and eliminates positions used to recruit new business members.

Sam’s Club Chief Executive Officer Brian Cornell said on Sunday that the retailer would outline charges associated with the job cuts in February, when it releases fourth-quarter results. He said he did not expect any “material impact” on its financial results.

“We look at this as an investment in the in-club experience,” Cornell said in an interview. “This is not a cost-cutting move for us in the short term. We really hope it will be cost neutral for our operation. It’s an investment in building loyalty, enhancing the member experience and driving future growth.”

Cornell took the helm at Sam’s Club on April 3 last year and has been looking for ways to boost its sales and increase its membership ranks. Members pay an annual fee to shop in its clubs and get discounts on everything from bulk-sized packages of toilet paper to raspberries.

Sam’s Club said it will use Shopper Events, a third-party company, instead of its own employees to run in-store product demonstrations and hand out food samples — a popular tactic used by warehouse clubs to entice shoppers to buy new items.

In a memo to employees, Cornell said Shopper Events will develop a demo program, called “Tastes and Tips”, that will offer improved demonstration of items like food, beverages and electronics.

The shift means Sam’s Club will cut 10,000 jobs primarily held by part-time workers. Current Sam’s Club demo employees can apply for new jobs with Shopper Events.

Brian Pear, general manager for Shopper Events, said his company would hire about the same number of employees being let go by Sam’s Club. But he said there was no guarantee it would hire former Sam’s Club employees to fill the positions.

Cornell and Pear declined to disclose terms of the deal.

Sam’s Club, the No. 2 U.S. warehouse club operator behind Costco Wholesale Corp, also said it was cutting the new business membership representative position, or employees in its stores who focused on recruiting new members. That will result in the loss of about 1,200 jobs, or about two jobs per every location.

Sam’s Club said it was having more success recruiting members through direct marketing or doing price comparisons, where it shows consumers how much money they could save by shopping in its clubs.

Craig Johnson, president of consulting firm Customer Growth Partners, said it made sense for Cornell to announce such extensive job cuts early on in his tenure.

“If you need to take a hit to get your cost structure down, you want to do that sooner versus later,” he said. “Given that it’s the end of the fiscal year, now is probably the best time to take the hit.”

Wal-Mart’s fiscal year ends on January 31.

While Sam’s Club said the move was not a cost cutting one, Johnson said companies like Shopper Events, which specialize in in-store sampling, can typically deliver those types of services less expensively than a retailer can.

The latest job cuts come after Sam’s Club said earlier this month that 1,500 jobs would be lost as it closed 10 money-losing stores.

At Wal-Mart’s meeting for analysts in October, Cornell said that Sam’s Club was shifting its focus from opening new clubs to remodeling existing ones as it works to increase sales.

He said then that the retailer was testing a new store layout, adding more food and drugs to its shelves, and streamlining operations to reduce labor hours in its clubs by 6 percent to 8 percent over the next five years.

Sam’s Club operates some 600 clubs and has about 110,000 employees.

Wal-Mart shares closed on Friday up 2 cents at $52.94.

Anti-Chavez channel removed from cable

CARACAS, Venezuela (AP) – A cable-television channel critical of President Hugo Chavez was yanked from the air early Sunday for defying new government regulations requiring it to televise some of the socialist leader’s speeches.

Venezuelan cable and satellite TV providers stopped transmitting Radio Caracas Television Internacional, an anti-Chavez channel known as RCTV, after it did not show the president’s speech Saturday to a rally of supporters.

While five other channels were also dropped from cable, some say the government took broader action to disguise its mission to shut down a popular, critical media outlet ahead of congressional elections and amid rising discontent over inflation, crime and electricity shortages.

RCTV already was forced to switch to cable in 2007 after the government refused to renew its license for regular airwaves. Chavez accused the station then of plotting against him and supporting a failed 2002 coup.

Chavez said Sunday the latest action is about following the law.

“Whoever refuses to comply with the law, that’s what must be done,” he said on his weekly broadcast, calling for a round of applause for the telecommunications agency.

If channels don’t comply, he said, they won’t be allowed back on the air: “It’s their decision, not ours.”

Under the new rules, two dozen local cable channels, including RCTV, must carry government programming when officials deem it necessary, just as channels on the open airwaves already do. Chavez regularly uses that legal power to order broadcast TV and radio stations to carry his marathon speeches, which can last up to seven hours.

Though Chavez remains Venezuela’s most popular politician, he has slipped in the polls and is campaigning against an emboldened opposition to keep control of the National Assembly in September elections.

RCTV has asked the Supreme Court to block the new regulations. RCTV called the government’s actions illegal in a statement, saying the channel has done nothing wrong and has a right to defend itself.

In Caracas neighborhoods, Chavez opponents leaned out apartment windows early Sunday to bang on pots and pans. Others shouted epithets and drivers joined in, honking car horns.

The national journalists’ association called it a violation of human rights and freedom of speech. Its president, William Echeverria, condemned it as an “increase in censorship.”

The U.S. Embassy also saw cause for concern.

“Access to information is a cornerstone of democracy,” U.S. Embassy spokeswoman Robin Holzhauer said. “By restricting yet again the Venezuelan people’s access to RCTV broadcasts, the Venezuelan government continues to erode this cornerstone.”

Five international channels – Ritmo Son, Momentum, America TV, American Network and TV Chile – also were suspended after not providing authorities with required information about their programs and ownership, said Mario Seijas, president of Venezuela’s subscription television chamber. He said other cable channels are in similar situations and could be taken off the air if they don’t turn in required documents in the coming days.

Government figures say about 37 percent of Venezuelan homes received cable television in 2008. But some private companies say their research shows about six out of every 10 households have subscription TV service.

RCTV has a smaller audience than it did in 2007 but has remained popular. The channel claims that 90 percent of cable viewers say they watch RCTV.

“A hard-line current within the Chavez movement would have the government permanently take Radio Caracas off the air,” said Steve Ellner, a political science professor at Venezuela’s University of the East. “There are some Chavez movement leaders, however, who believe that the measure is ill-timed given the government’s current woes such as the rationing of electricity.”

Michael Shifter of the Inter-American Dialogue think tank in Washington said Chavez’s aim is censorship. “He is nervous about mounting problems and slipping popular support, so he is moving aggressively to tighten his grip on all fronts,” Shifter said.

In August, Chavez’s government forced 32 radio stations and two small TV stations off the air, saying some owners had failed to renew their broadcast licenses, while other licenses were no longer valid because they had been granted to owners who are now dead.

JOS, Nigeria (AP) – An international human rights group is calling on Nigerian officials to investigate reports that at least 150 Muslims were killed in a central Nigerian town.

Human Rights Watch on Saturday cited reports of a massacre in a town located south of Jos, where fighting broke out between Christians and Muslims about a week ago.

Witnesses said that armed men attacked on Tuesday and that some of the victims were burned alive. One official said that the bodies of 22 young children had been recovered.

Muslim leaders told Human Rights Watch at least 364 people have been killed in the last week, while the Christian death toll was still being compiled.

Sectarian violence in this central region of Nigeria has left thousands dead over the past decade.

Like other reporters in the Austin-area, the Infowars team was immediately sent to the Texas Capitol building on news that a man, identified as Fausto Cardenas, had started shooting for no apparent reason.

There wasn’t much else to discover once we got there. The suspect had apparently harmed no one and State Troopers were quietly combing over the South steps with their investigation. Apart from reports about an angry visit to State Senator Dan Patrick’s office, there was no indication of a possible motive for the bizarre incident. Spokeswoman Tela Mange was polite but offered very little info.

I had catalogued all the activity going on behind the roped-off area and wandered around the other side of the Capitol to film another grouping of troopers who were combing the grounds with a (presumably bomb-sniffing) dog. When a trooper noticed me filming their quiet investigation, everything suddenly changed.

Though the building itself was closed, the Capitol grounds remained open, and people were milling about freely. Only the area immediately surrounding the South steps was restricted by yellow tape. This was not that area.

Yet this officer approached me sternly, pointing his finger and commanding that I ‘point the camera somewhere else’ and provide ID. I refused.

For those who have forgotten, in the haze of post-9/11 paranoia, America is not a ‘papers please’ dictatorship or a corrupt banana republic, even if certain forces are attempting to drag us in that direction.

Outside the Capitol, ostensibly a monument to free society, there was no reason to impose ’security’ in the face of natural public order. There was no panicked atmosphere; the shooting was clearly over. Media personnel, news cameras and other spectators were waiting around calmly.

So why did this officer feel the need to rush up and demand I justify myself? Were I suspected of a crime as benign as speeding such action might have been warranted, but I had literally done nothing but look in the wrong direction and catch the eye of the wrong person.

His name is known, but not important in this instance. He ceased being an officer, abandoning due process for arbitrary power. That is against the law– the spirit of the law– and thus I felt compelled not to go along with it. He asked if I had ID and I told him truthfully that I did, but did not feel I should give it.

He told me not to move as he called over his superior officer. I asked if I was being detained. “Yes,” he answered clearly. I was now considered a supsicious person for not producing my driver’s license on demand for no reason.

After a few minutes of impatient waiting, the superior officer asked a few questions, discovered I had done nothing at all and let me go without further ado. And yet, something had happened at the Capitol.

There, as elsewhere, with every capricious event, came a clumsy hardening of the system. Everytime an unpredictable person surprises us with a crime or even “act of terror” in an otherwise ordinary place, we act not with order and resolve– showing the strength of good laws. We instead react with panic and fear, as we begin regarding everyone with suspicion.

The result is a loss of our principles, and a compromising of good laws with ‘emergency power’ to meet a crisis. Not pursuit of a crime in progress, but a publicly-trusted and oath-sworn officer frightfully uncertain if he is looking out at his fellow-citizens or a sea of potential criminals and potential ‘terrorists.’

In our fear, we capitulate to the purveyors of chaos and lawlessness. Have we truly, fundamentally reached a point where we are so ‘terrorized’ that we really do throw out the baby with the bathwater? The wisdom and protection of the Constitution is our most precious public holding. Would we really violate it for such small urgings?

Twitter joke led to Terror Act arrest and airport life ban

When heavy snowfall threatened to scupper Paul Chambers’s travel plans, he decided to vent his frustrations on Twitter by tapping out a comment to amuse his friends. “Robin Hood airport is closed,” he wrote. “You’ve got a week and a bit to get your shit together, otherwise I’m blowing the airport sky high!!”

Unfortunately for Mr Chambers, the police didn’t see the funny side. A week after posting the message on the social networking site, he was arrested under the Terrorism Act and questioned for almost seven hours by detectives who interpreted his post as a security threat. After he was released on bail, he was suspended from work pending an internal investigation, and has, he says, been banned from the Doncaster airport for life. “I would never have thought, in a thousand years, that any of this would have happened because of a Twitter post,” said Mr Chambers, 26. “I’m the most mild-mannered guy you could imagine.”

Tim Geithner Will Be Fired After The November Elections

Tim Geithner is in a lot of hot water.

But he won’t quit or be forced to leave office until after the mid-term elections.

We would like to see Geithner go now. He has badly bungled the financial rescue and failed to lead on financial regulation reform. He is now so discredited on Capitol Hill that there is little chance he can be effective as Treasury Secretary.

But there’s little chance this will happen. The Obama administration cannot afford to show weakness. If it caved to Congressional critics of Geithner, lawmakers would be further emboldened to chip away at the president’s authority. Senate Republicans would likely turn the confirmation hearing of Geithner’s replacement into a brawl—one that would not reflect well on the White House or Democrat Congressional leadership.

There’s also little political upside to getting rid of Geithner now. It will not save Congressional Democrats any seats in the mid-term election. Obama’s popularity ratings won’t rise.  None of the administration’s priorities will be furthered by firing Geithner.
